The company is considered a taxi service brokerage firm, for the purposes of Decree 314/2016, of November 8, which establishes the specific conditions for the contracting and marketing of taxi services and the legal framework for brokerage activities.

These Terms of Use (“conditions”) establish the rules that regulate the use by the passenger (“User”) of the services contained in www.radiotaxi033.com (“WEB 033”), property of TAXI SERVICES PROVIDER SL (“Company”).

For your convenience we have a version translated into different languages, but this version (in Spanish) is the only legally binding one.

ACCEPTANCE OF THE GENERAL CONDITIONS

Before you can access the telephone services and those contained on "WEB 033," you must expressly accept these terms and conditions. If you do not accept these terms and conditions, you will not be able to access the services contained on "WEB 033."

By submitting your service request through any of the service request channels available through the "Company," you confirm that you have read, understood, and accepted these terms and conditions. You also confirm that you have the legal capacity and authority to accept these terms and conditions on your own behalf and/or on behalf of your companions. Therefore, you must notify us of any modifications or cancellations you may make.

Acceptance of the “Conditions” will mean that you are legally bound to them. Therefore, WE PLEASE READ THESE “CONDITIONS” AND TERMS CAREFULLY before accepting them.

WITHDRAWAL

Both you and the “Company” may immediately terminate these “Conditions” and the services contained in “WEB 033” without having to express any reason.

The "Company" may modify these "Terms" at any time it deems appropriate. Modifications will be effective upon publication on the "Company" website and will be deemed accepted by the "User." Upon first use of the "Company" services through any of its channels, whether telephone or those contained on the "033 WEBSITE" and "eltaxi APP," consent will be deemed granted.

By formalizing your reservation, you confirm that you have read, understand and accept these conditions, and you also confirm that you have the necessary legal capacity and authority to accept these general conditions on your own behalf and/or on behalf of your companions. Consequently, you will be responsible for making timely payments, you must notify us of any modification or cancellation, and you must, upon receipt of the reservation confirmation, inform other travelers.

PROVISION OF TELEPHONE SERVICE – CALL CENTER

The “Company” has a telephone service through several intermediary telephone numbers to put the “User” in contact with the “Supplier” Taxi Driver, the management of immediate services and pre-reservations 365/24 (with modification, cancellation, adaptation of the service) connected directly through operating stations with a plurality of taxi drivers, so that the “User” can connect as quickly as possible with the taxi driver who can carry out the transportation.

SERVICES INCLUDED IN “WEB 033”

To use the services of "WEB 033," the "User" must register by providing identification information. The information must be true, accurate, and pertain to the "User." Only adults or minors with authorization from their legal guardian may register.

Once registered, the User will have free, non-transferable access to the "WEB 033" service, through which they can request a taxi. The "WEB 033" service will contact the nearest taxi driver and provide them with the User's location. If the taxi driver accepts the request, they will be provided with the User's identification information. Once the taxi driver accepts the service, any anomalies that may occur (delays, no-shows, etc.) will be their sole responsibility.

"WEB 033" provides an exclusive, free-of-charge intermediation service between the "User" and the taxi driver. Therefore, this exclusive service does not include any other services, and in particular: (i) internet connections (ii) contracting and payment for the transportation service (iii) passenger transportation contract between the taxi driver and the "User" (iv). For the purposes of filing a claim, the "User" will be provided with the taxi driver's details so that the relevant claim can be filed against him or her.

SERVICE PROVISION

The “WEB 033” is connected directly or through operating stations with a plurality of taxi drivers, so that the “User” can connect as quickly as possible with the taxi driver who can carry out the transport.

The mediation activity is limited to connecting the "User" with the taxi driver, and therefore, the "User" does not contract any transportation services on its own behalf. Therefore, the "User" cannot be guaranteed that taxis will always be available to provide the requested service. Although "WEB 033" is expected to be permanently operational, the "Company" does not guarantee the "User" that its availability will be uninterrupted.

MINIMUM PRICES FOR TAXI SERVICES – CALL CENTER TRANSMISSION SERVICE / TAXIWEB – Services Menu (2023)

Conventional Taxi Service: Minimum Issuer Amount € 10, taxis will be able to arrive at the pick-up area a maximum of € 4,5.
Premium Taxi Service: From 20 € The minimum service with a pickup origin in Barcelona and beyond. These amounts may vary depending on the AMB pickup location and the hourly rate (nighttime or holidays). The minimum amount is offered in advance by the operator or Taxiweb system to the user, who, by accepting the service confirmation, accepts the minimum price conditions offered by the station. Taxis may arrive at the pickup area by dialing a maximum of € 4,5.
Adapted Taxi Service: From 20 € The minimum service with a pickup origin in Barcelona and beyond. These amounts may vary depending on the AMB pickup location and the hourly rate (nighttime or holidays). The minimum amount is offered in advance by the operator or Taxiweb system to the user, who, by accepting the service confirmation, accepts the minimum price conditions offered by the station. Trusted Taxi Service: Taxi arranged with at least 1 (working) day in advance through Trusted Taxi Driver code, Minimum Issuer Amount €15. The minimum amount is previously offered by the Taxiweb Operator or System to the user who, by accepting the confirmation of the service, accepts the minimum price conditions offered by the station. The maximum number of taxis will be able to arrive by dialing the pick-up area, a maximum of € 4,5.
Parcel Service: Minimum Issuer Amount € 7,5, taxis will be able to reach the pick-up area at most, a maximum of € 4,5 with an extra of € 4,30The minimum amount will be offered to you by the Operator.
Cost of abandonment of service o cancellation by the "User" when the service is being dispatched (taxi on the way):
- Conventional Taxi: Station minimum applies: €10
- Trusted Taxi: Station minimum applies: €16
- Premium Taxi: Station minimum applies: €22

IMPORTANT: Following our assessment, the "User" may receive an SMS, email, or phone call to pay the minimum fare for the taxi service. Failure to pay this amount will result in the cancellation of any of our services to the "User," and we will exercise our right to refuse service on future requests. MINIMUM APP SERVICE PRICES:

Service at Taximeter price: The previously mentioned broadcaster prices apply.
Closed price service: Predefined price. The origin and destination must be entered for calculation purposes. A 5-minute waiting time at the pickup point is included. Intermediate stops, origin/destination changes, parcel delivery, or pet services are not permitted. Minimum service charge is €8. SERVICE CANCELLATIONS

If the “User” decides to cancel a service after being accepted by the taxi driver, the taxi driver may act in accordance with current legislation regarding cancellation of reservations.

AUTOMATIC CANCELLATION OF THE SERVICE

The system may automatically cancel any type of service requested through any request channel when there are no taxis in the area willing to provide the service, whether it is an immediate service or a pre-reservation. Communication is made by phone call to the number provided, a maximum of 15 minutes after the requested time or time set in a pre-reservation. RESPONSIBILITIES

The "Company" shall only be liable for damages caused by the installation of "WEB 033" on the "User's" device, except for those arising from unforeseen circumstances or force majeure. It shall not be liable for the loss of the "User's" data, which, for any reason, may be caused by the operation of the application, as it is the "User's" obligation to make the corresponding backup.

The “Company”, to the extent of its possibilities and with due diligence, will ensure that the taxi drivers who have accepted the service requested by the “User”, respect the rights of the “Users” and that they comply with the obligations imposed on them. they impose on them. To this end, the "User", in the event of any infringement by the taxi driver, may request the "Company" to provide the necessary data for them to respect the rights that this title recognizes to consumers and users and comply with the obligations set forth therein. they impose on them.

As a mediator, the “Company” will not incur liability for the fact that the selected taxi driver does not provide all or part of the mediated service or does so late or does not appear to provide the taxi transportation service, whether has requested through any of the available channels (Phone, WEB-Forms, TaxiPC, TaxiWeb, or Eltaxi APP)

The improper use of “WEB 033” by third parties using the “User” application will not be the responsibility of the “Company”.

ADMISSION RIGHTS

The Provider (Taxi Driver) shall have the right to refuse to transport any person who is under the influence of alcohol or drugs.

Neither we nor any of our Suppliers accept any responsibility for any additional expenses incurred by the “USER” as a result of such conduct.

The consumption of alcohol and narcotic substances is strictly prohibited in vehicles. Smoking is not allowed inside them.

INTELLECTUAL PROPERTY

All content such as texts, montages, 033 brand, graphics, images, brand, subdomains and software used on the website “WEB 033” are the exclusive property of the “Company”, and the “User” is prohibited from any copy, modification or alteration of the same, including access, use or storage of personal data that may be accessed through the application.

APPLICABLE LAW AND COMPETENT JURISDICTION

TAXI SERVICES PROVIDER, SL.L is not a member of the European Commission's voluntary dispute resolution process.

These General Terms and Conditions, as well as any relationship between the “Company” and the “User” will be governed by Spanish law. For any dispute arising from the existence, content and/or interpretation of said General Terms and Conditions or any relationship between the "Company" and the "User", both parties submit to the jurisdiction of the Courts of the city of Barcelona. .

The “Company” reserves the right to make changes at any time to its website, as well as to these General Terms and Conditions.
